Most business will face a customer who refuses to pay their bill or disagrees with the sum of an invoice at some point. Things are not always as hopeless as they seem and with good advice and quick action we can help you get back on your feet.

In NSW, the process of debt recovery contains multiple steps. In an attempt to recover the debt it is typical for the creditor to reach out to the debtor, as well as to attempt methods of alternative dispute resolution to resolve the matter. If the matter cannot be resolved, the last resort is to take the matter to court.

If you are owed money that you would like to collect you can take legal action to recover it. In certain situations, you can also recover your legal costs related to recovery proceedings.

At Eleven Legal one of our experienced lawyers can assist you with:

  • Preparing and sending a letter of demand;
  • Preparing a Statement of Claim – used to demand either payment or defence of the matter within 28 days (after the Statement of Claim is served); and
  • Entering Judgment against the debtor (when no action is taken within 28 days.

Once a Judgment is entered, there are a number of procedures available to enforce it. At Eleven Legal, we can assist you with this process – whether it be Writs (seizure of goods to sell in order to repay the debt), Examination Summons (requiring the debtor to attend Court to display how they will satisfy the Judgement), or Garnishees Orders (whereby the Court can order a third party to pay money to a creditor instead of a debtor).
