If a family member has recently passed away, you may have been told that you need a Grant of Probate to administer their estate. We can assist with as much or as little of the process as you need help with.
The process of obtaining a Grant of Probate through the Supreme Court of NSW may be overwhelming. To obtain probate there are a few steps that you need to complete:
- Obtain the Death Certificate;
- Locate the original will. If there is no will, then you will need to apply for Letters of Administration rather than a Grant of Probate;
- Prepare your Court documents and your affidavit;
- Advertise your intention to apply for probate; and
- Calculate the deceased’s assets and liabilities.
Discounted Probate Fees
At Eleven Legal, we recognise that the fee scale set out below can make applying for probate quite expensive for an estate. For this reason, we typically offer the following discounts for our fee component for assets within NSW. If you wish us to provide you an exact pricing, please reach out to us:
- If the value of the estate exceeds $3 million, we will apply a 25% discount;
- If the value of the estate exceeds $4 million, we will apply a 35% discount;
- If the value of the estate exceeds $5 million, we will apply a 40% discount; and
- If the value of the estate exceeds $6 million, we will apply a 45% discount.
Not every estate requires a Grant of Probate, whether it is required will depend on the nature and extent of the assets. For instance, when it comes to assets held jointly the survivor usually becomes the sole owner on the death of the other joint owner. If the estate assets are of minimal value, it can be possible to deal with the assets without obtaining probate.
